Gustavo Castro (FoEI Mexico) files international complaint against Honduran State

Miguel Ángel de los Santos and Edy Tábora, lawyers of Gustavo Castro in Mexico and Honduras, respectively, have filed a complaint before the Inter American Commission on Human Rights (IACHR) according to what they said in a press conference held on Monday January 16 in Mexico city.

Over ten months after the murder of Honduran activist Berta Cáceres and the murder attempt against the member of Otros Mundos (Friends of the Earth Chiapas, Mexico), Gustavo Castro, the Honduran prosecution authorities have not presented charges against the person who shot the Mexican activist.

Seven people have been arrested, but it is still unknown whether the investigations will contribute with clearing up the intellectual responsibility of state officers and members of the Board of DESA company, since the files are still under secrecy. This leaves the leaders of the Civic Council of Popular and Indigenous Organizations of Honduras, COPINH, the relatives of Berta Cáceres and Gustavo in a situation of total defenselessness.

According to the complaint filed before the IACHR over the human rights violations against Gustavo Castro perpetrated by the Honduran State during his stay in the country in March, 2016, the Public Prosecutor´s Office, and Judge Victorina Flores of Intibucá Honduras, as well as the Supreme Court of Justice violated Gustavo Castro´s human rights by withholding him in the country and denying the habeas corpus measure filed by his lawyers with more than eleven Amicus Curiae, on June 16, 2016.

The complaint was filed before the Inter American Commission on Human Rights in December 2016, and a criminal complaint against Judge Victorina Flores, from the Esperanza Intibucá court, was filed this January.

Gustavo Castro and his lawyer consider that it is extremely serious that Judge María Luisa Ramos, of the Appeals Court, removed from the court the file about the murder of Berta Cáceres, which was then stolen in September, and they are not ruling out filing a complaint against her as well.
